Introduction of Trust to HOA Process by Brad Jones

​The below documents have been sent to all homeowners as part of a packet. If you have not received  your packet, please contact Brad Jones: bradj@preferredmanagement.org  570-842-2705. The ballot is not posted below. To vote, please follow the process outlined in the packet. We ask that ballots be returned by August 1, 2024. This is the first due date. This is not the official due date. This due date helps determine who we need to contact for voting reminders. The official date for the end of voting the November Members meeting.

  • Q - What is the due date for the ballots?

    • R - The first due date is August 1st. This is not the official due date. This due date helps determine who we need to contact for voting reminders. The official date for the end of voting the November Members meeting.

  • Q - What is the process for review, comment, revisions?​

    • R - As homeowners are reviewing the documents, if you have any questions, comments or concerns, please send them to Brad Jones in writing (email) so that we can address them for all homeowners in communications like this one.​

  • Q - Is the legal council that is working on this process the legal council for SRV?​

    • R - Yes and a second firm that specializes in this process is also assisting.​

  • Q - Do we need more insurance for the Board of Directors when we convert?​

    • R - No, as the Board is already insured as a Board of Directors. ​

  • Q - What are the tax cons​equences for moving from a Trust to an HOA?

    • R - Because we are a not-for- profit, there is no change in our tax structure.​

  • Q - Will we save money by moving from a Trust to an HOA?​

    • R- Yes, as we will not have to pay for a Trustee which can cost over $70,000 a year.​

  • Q - What if we don't get enough of the homeowners?​

    • R - There is a possibility that our attorneys could petition the court to have the judge determine if we can make this change.​

  • Q - Shouldn't the consent form have dates next to all of the signature lines? 

    • R - The dates on this form will be left blank until the vote passes and the official recording is completed at the courthouse.​
